Abstract

Este trabalho possui como pano de fundo a problemática da superposição de tratados surgida na América, em razão dos instrumentos destinados à cooperação jurídica na região, desde a ótica das CIDIPs. Nessa seara, a pesquisa centrou-se, por um método dogmático-hermenêutico, nas cláusulas de integração existentes nas convenções interamericanas, pois são uma das ferramentas que permitem a coordenação de fontes do emaranhado de tratados vigentes na América. A relevância do estudo dessa espécie de cláusula reside no fato de que, no direito internacional, a decisão de qual tratado aplicar no caso concreto, face a enorme quantidade de instrumentos sobre o mesmo tema, é tarefa dificultosa e obscura.

This article has as general matter, since the CIDIPs perspective, the overlapping of treaties emerged in America, due to the international instruments that are celebrated destined for legal cooperation in the continent. In this field, the research, through a technique and interpretative method, focused on the 'integration/compatibility clauses' that exist in the inter American conventions, since they represent one of the tools that allow the coordination of this normative sources that compose this tangled bunch of treaties in America. The relevance of the study of this type of clause lies in the fact that, in the international laws community, the decision of which treat will be applied, front of the enormous quantity of instruments over the same theme, is a difficult task.

Cette étude est basée sur la problématique de la superposition des traités survenue en Amérique à cause des instruments destinés à la coopération juridique régionale, selon les CIDIPs. Pourtant, la recherche a été centrée dans une méthode dogmatique-herméneuti- que dans les clauses d'intégration existantes aux conventions interaméricaines, étant donné quelles sont des outils qui permettent la coordination des sources entre les traités en force dans l'Amérique. La valeur de l'étude de ce genre de clause réside dans le fait que, en droit international, la décision pour le traité appliqué dans le cas concret, est une tâche difficile et obscure entre la quantité exorbitante d'instruments sur le même sujet.
