          Abstract

          RESUMEN El presente artículo aborda, desde una perspectiva teórica, la problemática de la efectivización de los derechos sociales de prestación. La tesis central del artículo sostiene que esta efectivización puede darse mediante un modelo progresivo de tres niveles, a saber: el nivel de la funcionalidad básica, el nivel de la optimización del bienestar y el nivel de la complementación del bienestar. El artículo inicia con la fundamentación de la equiparabilidad de los derechos sociales de prestación con los derechos fundamentales "tradicionales o clásicos", por ser dicha equiparabilidad el requisito teórico para justificar la justiciabilidad y efectivización de los derechos fundamentales prestacionales; a continuación, pasa a desarrollar la idea de obligación mínima esencial para luego incorporarla como primer nivel dentro de la estructura progresiva de efectivización. Finalmente, se pondrá a prueba este modelo teórico al reconstruir con base en el mismo el caso Cuscul Pivaral y otros vs. Guatemala resuelto por la Corte IDH.

          Translated abstract

          ABSTRACT This article addresses, from a theoretical perspective, the problem of the enforcement of fundamental social rights. The central thesis of the article claims that this enforcement can take place by means of a progressive three-level model, namely: the level of basic functionality, the level of welfare optimisation and the level of welfare supplementation. The article begins with the justification of the equiparability of fundamental social rights with the "traditional or classic" fundamental rights, this being the theoretical requirement to justify the justiciability and enforceability of fundamental rights; it then goes on to develop the idea of the minimum core obligation to incorporate it as the first level within the progressive structure of enforcement. Finally, this theoretical model will be tested by reconstructing the Cuscul Pivaral et al. v. Guatemala case, ruled by the Inter-American Court of Human Rights.

            Judging Social Rights

            Countries that now contemplate constitutional reform often grapple with the question of whether to constitutionalise social rights. This book presents an argument for why, under the right conditions, doing so can be a good way to advance social justice. In making such a case, the author considers the nature of the social minimum, the role of courts among other institutions, the empirical record of judicial impact, and the role of constitutional text. He argues, however, that when enforcing such rights, judges ought to adopt a theory of judicial restraint structured around four principles: democratic legitimacy, polycentricity, expertise and flexibility. These four principles, when taken collectively, commend an incrementalist approach to adjudication. The book combines theoretical, doctrinal, empirical and comparative analysis, and is written to be accessible to lawyers, social scientists, political theorists and human rights advocates.
