          Abstract

          Una barrera para la existencia de un mayor diálogo y entendimiento dentro de la teoría jurídica es la falta de reconocimiento de la variedad de formas y propósitos de las diferentes teorías de (o sobre) la naturaleza del derecho. Los teóricos del derecho son en cierto modo culpables por la falta de una discusión más clara acerca de cuestiones metodológicas, en la medida en que, con frecuencia, no son tan claros como podrían serlo si prestasen atención a la naturaleza de las afirmaciones que hacen (e.g. descriptivas versus prescriptivas, conceptuales versus empíricas), o al proyecto general del cual sus teorías son parte. Este trabajo intenta ofrecer un somero repaso de los tipos y propósitos de la teoría del derecho, enfocado principalmente en teorías sobre la naturaleza del derecho. Otro tipo de teorías -e.g. en lo concerniente a los derechos o a la mejor aproximación al razonamiento jurídico o judicial- requerirán otra descripción.

          Translated abstract

          One barrier to greater dialogue and greater understanding within Jurisprudence is the failure to appreciate the variety of forms and purposes among the different theories of or about (the nature of) law. Legal theorists are often somewhat to blame for the failure of clearer discussion about methodological issues, as they are frequently not as clear as they might be regarding the nature of claims they are making (e.g., descriptive versus prescriptive, conceptual versus empirical) or regarding the larger project for which their theories are a part. This entry attempts to offer a rough overview of the types and purposes of legal theory. The focus is primarily on theories about the nature of law. Other types of theories -e.g., regarding rights or the best approach to legal or judicial reasoning- may warrant a different overview.
